Terms of Service

The agreement behind every package and monthly plan, written in plain English. Please read it before you buy.

Effective date: September 28, 2026

These terms are the agreement between you (the business buying from us) and Sailboat Sites ("we," "us," "our"). They cover buying a website package, a monthly plan, or an SEO and AI-search audit from sailboatsites.com.

We wrote them in plain English on purpose. If anything is unclear, email hello@sailboatsites.com before you buy.

By checking the terms box at checkout, or by paying for a package or plan, you agree to these terms. If you are buying for a business, you confirm you are allowed to agree on its behalf and that you are at least 18.

1. What you are buying

We sell three one-time website packages, two optional monthly plans, and a one-time SEO and AI-search audit. The pricing and services pages on sailboatsites.com list exactly what each one includes. Those lists are part of these terms.

Some things to know about the packages and plans:

  • Every package is custom-designed for your business. We do not resell templates.
  • Website redesign. A redesign is priced as a new website: you pay the price of the package you choose. We build your new site from scratch, keep the parts of your old site you want (for example your logo, photos, text and colors), move over the content you want to keep, and point your old page addresses to the new ones so existing links keep working.
  • Accessibility. Every package is built to meet the WCAG 2.1 Level AA accessibility standard at launch. Flagship also includes a written accessibility statement for your site and an accessibility audit report. We build to the standard; we do not give legal advice about whether any particular law applies to your business. Content or features you (or anyone else) add after launch can affect accessibility.
  • Search features (SEO and GEO). Where a package includes search work, including Flagship's Google Business Profile optimization, we do the work to a professional standard. No one can promise a specific search ranking, and we do not.
  • Maintenance plan ($99 per month). For sites we built; if we did not build your site, email us for a quote. It covers: hosting your site; security and software updates; uptime monitoring; a monthly check that your site still passes our accessibility and speed checks; up to 2 small edits a month (for example, swapping text or a photo); and replies to your requests within 2 business days. New pages, new features and redesigns are not small edits; we quote them separately before any work starts.
  • Yacht Club and Flagship include your first month of Maintenance at no charge.
  • Monthly analytics report ($49 per month). Available for any website, whether or not we built it. It needs read access to your website's analytics accounts. The report covers your website's own analytics only: your hosting platform's analytics, Google Search Console, Bing Webmaster Tools, Google Analytics 4, and Shopify (if you use it). It explains what the numbers show. It is not business, marketing, legal, or financial advice.

SEO and AI-search audit

  • What it is. The audit costs $99, paid once, and covers one website. You get a report as a slide deck of up to 24 slides: the problems we find, ranked by impact, a fix for each, what your competitors do, and a suggested timeline.
  • Delivery. We email your audit report within 5 business days of your purchase.
  • Audit credit. If you buy a website package within 30 days after we deliver your audit, we take the full $99 off that package's price. The credit is used once, on one website package, by the business that bought the audit. It is not paid out in cash and does not apply to monthly plans. To use it, email us before you check out and we will send you a checkout link with the credit applied.
  • No ranking promises. The audit tells you what we find and what to fix. No one can promise a specific search ranking, and we do not.

We may change our prices or package contents in the future. A change never affects a package, audit or month you have already paid for.

2. Payment

  • Packages are paid in full, up front, at checkout. We start work after payment clears.
  • Monthly plans are billed in advance each month on the same day of the month you signed up, and renew automatically until you cancel. Our Refund and Cancellation Policy explains how to cancel.
  • Extra revisions are $50 each, paid before we start that revision.
  • Payments are processed by Stripe. We never see or store your full card number.
  • Prices are in U.S. dollars and do not include any tax that may apply.

3. How a project works

  1. You pick a package and pay.
  2. You fill out our intake form and send us your content: your logo, photos, and anything else the site should show. By default, we write your page text from your intake answers and you approve it. If you would rather write it yourself, or you already have text, tell us on the intake form and we will shape it to fit the design.
  3. We design and build your site and send you a private preview link to review.
  4. You request changes using your included revisions (see section 6).
  5. We launch your site on your domain and hand it over with a plain-English owner's guide and a short recorded walkthrough video. Flagship also includes a live walkthrough call.

Timing. We deliver your site in 3 to 10 days, backed by our delivery guarantee in section 4. Flagship projects start first in our queue.

If a project goes quiet. If we have not heard from you for 60 days after we ask for something we need, we may close the project. Before we do, we will email you at least twice. If we close it, we will deliver whatever work is finished at that point, and no refund is owed beyond what our Refund and Cancellation Policy says.

4. Our delivery guarantee

We ship your site in 3 to 10 days, or it's free. Here is exactly how it works.

  • What "delivered" means. We send you your complete, working site on its private preview link. Revision rounds, domain access, and launch day come after delivery and are not part of the deadline.
  • When the clock starts. The clock starts when you have submitted your intake form and we have received the information it asks for (for example your logo, photos, and answers). If something is missing, we will tell you what it is, and the clock starts once it arrives.
  • The deadline. 240 hours (10 days of 24 hours, counted to the second) after the clock starts. Delivering sooner, even before day 3, is fine.
  • If we miss it. If we have not delivered by the deadline, we refund 100% of the package price you paid ($250, $500, or $1,000), and we still finish your site and hand it over to you. The refund is paid as our Refund and Cancellation Policy describes.
  • What it covers. The guarantee covers the three website packages, including a redesign bought as one of them. Monthly plans (Maintenance and the Monthly analytics report) and the SEO and AI-search audit are not part of it; the audit has its own delivery time (section 1).

5. What we need from you

You are responsible for:

  • Your content. Giving us the images, logos, prices, hours, and other information for your site (and any text you choose to write yourself), on time.
  • Accuracy. Making sure everything you give us is true and up to date. We build what you give us; we do not fact-check your business claims, prices, licenses, or credentials.
  • Rights to what you supply. You confirm you own, or have permission to use, everything you send us (photos, logos, text, trademarks, reviews). If someone claims your material infringes their rights, that is your responsibility, not ours.
  • Legal requirements that are specific to your business. For example, license numbers, industry disclosures, or rules about advertising your services. We can place them on the site; you must tell us what they are.
  • Timely review. Reviewing drafts and answering questions so the project can keep moving.
  • Access. Giving us access to the accounts we need (for example your domain registrar or booking tool). Where a service lets you invite us as a user, please do that instead of sending us your password. We will never ask for your password by email.

Medical and health providers. The sites we build never collect protected health information (PHI): no patient intake forms, no health questions in contact forms, and no patient chat. Visitors contact you by phone or through links to your own systems. Please do not send us any patient information at any time.

6. Revisions

  • What a revision is. One revision is one round of changes: you send us one list of changes, and we make them. A list can include redesigning parts of your site or adding new pages.
  • Included revisions: Sailboat 1, Yacht Club 1, Flagship 3.
  • Extra revisions: $50 each.
  • Fixing our mistakes is free. If something does not match what we agreed, or does not work as it should, fixing it does not use up a revision.
  • Revision window. Included revisions must be used within 30 days after launch.
  • Upgrades. A feature that belongs to a bigger package (for example, online booking on a Sailboat site) is an upgrade, not a revision: you pay the difference in price between the two packages. We will confirm it in writing before we start.

7. Who owns the finished site

Once your package is paid in full and your site is delivered, you own your finished website and everything in it, including all of its code, the design we made for you, and the written content we wrote for you. There is no handoff fee. Our general tools, internal systems, processes, and know-how (the things we use to do the work, which are not part of your site) stay ours.

Everything you gave us (your text, photos, logo, and brand) was always yours and stays yours.

Third-party parts. Your site may use open-source software, fonts, icons, or stock images that belong to others. Those stay under their own licenses. We choose ones that allow commercial use on your site.

How we build. We use modern software tools, including AI-assisted tools, as part of how we design and build. Every site is reviewed by our team before it is delivered.

Our credit and portfolio. We may show your finished site in our portfolio and marketing unless you tell us not to. We may also place a small "Site by Sailboat Sites" credit in your site's footer, which we will remove if you ask.

8. Hosting and domains

  • Hosting. We host every site we build on our own hosting account with Vercel.
    • Maintenance plan: while you have Maintenance, hosting is included.
    • Without Maintenance: we host your site free for 30 days after launch. By then, you can add Maintenance, or ask us to move your site to your own hosting account at no charge.
    • Reminders and handoff: we email you a reminder a week before day 30 and again on day 30. If by day 30 you have not added Maintenance or asked for the handoff, we email you the complete handoff package (all of your site's files and instructions for moving it). We keep your site live on our hosting for 30 more days, then take it off our hosting. That is 60 days in total from launch, and your site never disappears without warning.
    • Yacht Club and Flagship: your first month of Maintenance, including hosting, is free.
  • Domains. You register and own your domain name, in your own name and in an account you control, and you pay the domain registrar directly. Your package includes connecting your domain to your site.
  • Leaving. If you ever want to move your site elsewhere, we will move it to your own hosting account or give you a complete copy of its files and code. There is no handoff fee.

9. Third-party services

Your site may rely on outside services, such as your hosting platform, domain registrar, booking tools, payment processors, email services, maps, or analytics. For example: Vercel, Stripe, and Google.

  • Those services have their own terms and fees, and you may need your own account with them.
  • We are not responsible for their outages, price changes, policy changes, or the way they handle data.
  • If a third-party service changes in a way that breaks part of your site, fixing it is billed as new work, and we will tell you the price before we start.

10. What we will not build

We may decline or stop any project at our discretion. We do not build sites that:

  • break any law, or help anyone else break one;
  • infringe anyone's copyright, trademark, or other rights;
  • are false, misleading, defamatory, hateful, harassing, or sexually explicit;
  • collect protected health information (see section 5); or
  • are meant to spread malware, spam, or scams.

If we find out after payment that we will not build a project, we will stop work and handle the refund as our Refund and Cancellation Policy describes.

11. Warranties and disclaimers

We promise to do the work in a professional way, to deliver what your package describes, and to keep the delivery guarantee in section 4.

Apart from those promises, the website and our services are provided "as is." To the fullest extent the law allows, we make no other promises, including promises about:

  • sales, leads, traffic, or search rankings;
  • your site being error-free or online without interruption; or
  • your site meeting a particular law or regulation that applies to your business.

Bug-fix window. If you find something we built that does not work within 30 days after launch, tell us and we will fix it at no charge. Problems caused by later changes made by you or someone else, or by third-party services, are not covered.

12. Limitation of liability

To the fullest extent the law allows:

  • Our total liability for any claim about our services is limited to the amount you paid us for the service the claim relates to.
  • We are not liable for indirect or consequential losses, such as lost profits, lost sales, lost data, or damage to reputation.

Some places do not allow some of these limits, so they may not all apply to you.

13. Your responsibility to us

If someone makes a claim against us because of material you supplied, or because of how you run your business or use your site, you agree to cover our reasonable costs of dealing with that claim.

14. Ending the agreement

  • Monthly plans: you can cancel any time, as our Refund and Cancellation Policy explains.
  • Packages: you can cancel a project at any stage. What you get back depends on the stage, as our Refund and Cancellation Policy explains.
  • By us: we may end a project or plan if you break these terms, do not pay, or ask us to build something section 10 excludes. If we end a project for a reason that is not your fault, you get a full refund. If we end it because you broke these terms, the refund follows the stage table in our Refund and Cancellation Policy.

Sections 7 (ownership, for work you have paid for), 11, 12, 13, and 16 still apply after the agreement ends.

15. Changes to these terms

We may update these terms. We will post the new version on this page with a new effective date. Changes never apply to a package or month you have already paid for. For monthly plans, we will email you at least 30 days before a change that affects you.

16. Governing law and disputes

These terms are governed by the laws of the State of California.

If we have a disagreement, please email us first. Most problems get solved faster that way. If we cannot solve it together, the dispute will be handled in the state or federal courts located in California.

17. Everything else

  • These terms, the package descriptions on our pricing page, our Privacy Policy, and our Refund and Cancellation Policy are the whole agreement between us.
  • If one part of these terms turns out to be unenforceable, the rest still applies.
  • If we do not enforce a term right away, we can still enforce it later.
  • You may not transfer this agreement to someone else without our written permission.
